This Consent Form (“Consent”) is issued by Zealver Living Private Limited (“Company”) for the purpose of obtaining your informed and explicit permission for the collection, use, processing, and sharing of your personal and health-related data. The Company is committed to safeguarding your privacy in accordance with applicable data protection laws, including the Digital Personal Data Protection Act, 2023 (“DPDP Act”), the General Data Protection Regulation (“GDPR”), and the Health Insurance Portability and Accountability Act (“HIPAA”).
Your use of the Company’s services is governed by the Privacy Policy and Terms of Use, available at https://www.zealver.life/privacy-policy/ and https://www.zealver.life/terms-conditions/ respectively. You are requested to read and accept these documents prior to using the services.
The Company may collect and process personal data, including your name, contact number, email address, age, gender, and location, as well as account and login credentials required to access the services.
In connection with the provision of healthcare services, the Company may additionally collect sensitive health-related information, including your medical history, symptoms, diagnoses, prescriptions, consultation records, laboratory reports, health metrics, insurance and billing details, communication and consultation history, and any other information reasonably necessary for the provision of patient care.
Your personal and health data will be processed strictly for the following purposes: providing healthcare consultations and services as defined under your subscribed plan; facilitating diagnosis, treatment, and care coordination; maintaining accurate and complete medical records; improving the quality of services and conducting service analytics; ensuring compliance with applicable legal and regulatory requirements; and communicating with you regarding your care through teleconsulting and video consulting platforms.
The Company may share your data with doctors, healthcare professionals, diagnostic laboratories, and pharmacies, who may be engaged as third-party vendors. Your data may also be shared with technology and service providers supporting the platform’s hosting, analytics, and operational functions. Additionally, disclosure may be made to regulatory authorities where required by law.
All third parties with whom your data is shared are bound by confidentiality obligations and data protection requirements consistent with applicable law. Your data will not be shared for marketing or any purposes unrelated to your care without your express, separate consent.
Your data may, where necessary, be transferred to and processed in jurisdictions outside your country of residence, including jurisdictions that may have different data protection standards. In all such cases, the Company will ensure that appropriate safeguards are in place before any cross-border transfer is effected, in accordance with applicable law.
The Company will retain your personal and health data for as long as necessary to fulfil the purposes for which it was collected and to comply with applicable legal obligations. Upon expiry of the applicable retention period, your data will be securely deleted or irreversibly anonymised.
You are entitled to access your personal data held by the Company and to request correction of any inaccurate information. You may withdraw your consent at any time, request the deletion of your data, and seek restriction of or objection to processing. Where technically feasible, you may also request portability of your data to another service provider.
You have the right to access and obtain copies of your health records, request corrections to your Protected Health Information (“PHI”), receive a detailed accounting of disclosures made of your PHI, and revoke this authorisation in writing at any time.
By using the Company’s services, you agree to provide accurate and complete information, maintain the confidentiality of your login credentials, and use the services solely for lawful and personal purposes. You shall not attempt to reverse engineer or reproduce any platform content, use the services for commercial gain, or upload material that is harmful, illegal, or offensive.
Where registration is required to access certain services, you acknowledge that you are solely responsible for all activities conducted under your account and that the Company shall not be held liable for any misuse of your credentials.
Access to certain services may require the creation and maintenance of a registered account. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. The Company shall not be liable for any loss or damage arising from your failure to maintain adequate account security.
The services provided by the Company are intended to offer support and guidance as part of your broader healthcare journey. They do not constitute a replacement for emergency medical care or physical examination where clinically required. In the event of a medical emergency, you must contact your local emergency services immediately.
By signing this Consent, you authorise Zealver Living Private Limited to use and disclose your Protected Health Information for the purposes of treatment, payment, and healthcare operations, and to share your PHI with healthcare providers and authorised partners as necessary for your care. This authorisation shall remain valid until it is revoked by you in writing. You understand that you may revoke this authorisation at any time by written notice to the Company, and that such revocation will not affect disclosures already made prior to the date of revocation.
You may withdraw your consent at any time by submitting a written request to the Company’s Data Protection Officer at dpo@zealver.life. Withdrawal of consent will not affect the lawfulness of any processing carried out prior to such withdrawal. However, withdrawal may limit the Company’s ability to continue providing certain services to you.
You acknowledge that the provision of your personal and health data is entirely voluntary. You understand that you may refuse to provide consent or withdraw it at any stage. You further acknowledge that such refusal or withdrawal may limit or prevent the Company’s ability to deliver its services to you.
